New York City Council introduces bill to allow citizens to bring civil enforcement actions for AI violations
A Local Law to amend the administrative code of the city of New York, in relation to civilian enforcement of artificial intelligence violations
The New York City Council introduced Int. No. 1101 on October 8, proposing a complaint mechanism for civil enforcement of AI violations. In addition to department personnel and other city employees authorized by law to serve violation notices, natural persons may submit evidence-based complaints; the department must investigate complaints that are not frivolous, fraudulent, or duplicative, and refer them to the corporation counsel. At least 180 days after receiving a complaint, the department must notify the complainant of the disposition: enforcement by the city, designation of the complainant or their attorney as special assistant corporation counsel, authorization to serve violation notices, or refusal with reasons stated. If the city enforces based on the complaint and collects penalties, the complainant may receive 25% of the amount collected; if a designated or authorized complainant brings suit or serves violation notices themselves and penalties are collected, they may receive 50%. The bill remains at the committee stage, and the text provides that if enacted it takes effect 180 days later.
