OpenAI and Altman move to dismiss Mall and Askins' lawsuit
MOTION TO DISMISS MALL AND ASKINS COMPLAINTS
OpenAI and Sam Altman filed a motion in the U.S. District Court for the Northern District of Florida to dismiss the lawsuit brought by Elizabeth Mall and Madison Askins over the FSU shooting. The motion, based on Rules 12(b)(2) and 12(b)(6), argues that product liability law does not apply to the dissemination of information, Florida law does not recognize a duty of care to prevent third-party violent crimes, the First Amendment protects the provision of information, and the court lacks personal jurisdiction over Altman. The case stems from the shooting at Florida State University on April 17, 2025, by Phoenix Ikner, which killed two people and injured several others. OpenAI says Ikner never revealed his intent to ChatGPT, and ChatGPT instead repeatedly condemned violence and suggested he seek mental health help.
