Governance lag index rises to 133 items: what it means for embodied AI regulation in the first quarter of 2026
[Daily Paper] The Governance Lag Index at 133 Entries: What Q1 2026 Tells Us About Regulating Embodied AI
Failure-First's Governance Lag Index (GLI) dataset has grown to 133 entries, used to record the time difference between when AI failure modes are documented and when regulatory responses occur; on February 2, 2026, the EU AI Act's prohibitive provisions become enforceable, marking the first binding AI enforcement milestone. The authors added four new entries, gli_130 through gli_133, covering this milestone, the EU AI literacy obligation, the abliteration governance gap, and Australia's advisory-only AI Safety Institute. The dataset shows that the largest completed GLI is for computer vision adversarial examples, from Szegedy et al. 2013 to NIST AI 100-2, totaling 3,362 days; the only one that can be fully calculated is prompt injection, at 1,421 days. Of the original 20 entries, 9 have no governance response at any stage, and these entries have empirical ASR above 79%. The next enforcement milestone is the EU AI Act's high-risk system requirements on August 2, 2026.
